PRESIDENTIAL ELECTION: PETER OBI, ATIKU DRAG TINUBU TO SUPREME COURT

The Candidates of the Labour Party, Mr Peter Obi and Peoples Democratic Party, have filed appeals at the Supreme Court challenging the September 6th the rulings of the Presidential Elections Petitions Tribunal, PEPT.

It will be recalled that the Justice Haruna Tsammani-led five-member panel of the PEPT, had dismissed the petitions of Obi and Atiku, challenging the election of President Bola Tinubu.

But not satisfied with the ruling, Obi, in his appeal, maintained that the Presidential Election Petition Court, PEPC, erred in law and thereby reached a wrong conclusion when it dismissed the petition he lodged to challenge the outcome of the presidential poll that was held on February 25.

Among other things, he contended that Justice Haruna Tsammani-led five-member panel of the Court of Appeal, wrongly occassioned a grave miscarriage of justice against him, when it held that he did not specify polling units where irregularities occurred during the election.

Atiku on his own, contends that the verdict of the Justice Haruna Tsammani-led five-member panel of the President Election Petition Court, PEPC, which dismissed his petition against the outcome of the presidential contest, was not only perverse, but occasioned a grave miscarriage of justice against him.

The PDP candidate, who is a former Vice President, maintained that the PEPC panel erred in law, when it failed to nullify the presidential election on the grounds of non-compliance with the Electoral Act, 2022, even when evidence that was adduced before it, showed that the Independent National Electoral Commission, INEC, acted in breach of extant laws and regulations guiding the conduct of elections.

While Obi’s case is summed on 51 grounds, Atiku’s appeal is based on 35 points.
